But CE marking and FDA clearance answer different questions. CE marking indicates that the manufacturer has completed the applicable European conformity assessment. FDA 510(k) clearance means the FDA has determined that a device is substantially equivalent to a legally marketed device known as a predicate. Neither status automatically opens the other market.
That distinction affects your launch date, budget, documentation, and even the claims your sales team can make. Here is the comparison first, followed by what it means for a real market entry plan.

Your Device Is CE Marked. What Has Actually Been Established?
For an EU medical device, CE marking follows the applicable conformity assessment. The manufacturer is responsible for demonstrating conformity, preparing the required technical documentation, and meeting the requirements that apply to the device.
A common point of confusion is who assesses that work. Some Class I medical devices can be CE marked without notified body involvement. Other Class I devices, including certain sterile or measuring devices, require a notified body for specified aspects of the assessment. Higher-risk classes generally require notified body involvement.
For a buyer or distributor, “Does it have a CE mark?” is therefore only the first question. The useful follow-up is: Does the declaration of conformity, and any applicable certificate, cover the exact device and intended purpose being offered?
Now imagine that the distributor is based in the US. The CE documentation may contain valuable evidence, but the mark itself does not answer the FDA’s next question.
What Does the FDA Want to Know for a 510(k)?
For a device that requires a 510(k), the manufacturer identifies a suitable legally marketed predicate device and demonstrates substantial equivalence. The FDA reviews the submission and issues a determination. A successful determination is generally what people mean when they say a device is FDA-cleared.
Before searching for a predicate, confirm the device’s US classification. Some devices are exempt from 510(k). A novel device without a suitable predicate may be eligible for the De Novo pathway, while certain devices require premarket approval (PMA). The pathway changes the evidence needed, the submission fee, and the project plan.

What If Your Launch Plan Also Includes the UK or India?
A two-column CE-versus-FDA comparison cannot answer every market access question. The UK and India each need a separate review.
Great Britain and Northern Ireland
For Great Britain—England, Scotland, and Wales—eligible CE-marked medical devices remain accepted under transitional arrangements. Depending on the device and the EU legislation it meets, the current end date is 30 June 2028 or 30 June 2030. Great Britain also has a UKCA route and applicable MHRA registration requirements.
Northern Ireland follows its applicable EU medical device framework. If a company says it is “launching in the UK,” the regulatory team should confirm whether that means Great Britain, Northern Ireland, or both.
For budgeting, the MHRA fee structure introduced on 1 April 2026 includes an annual £300 fee per applicable Level 2 GMDN category, or Level 1 where no Level 2 exists. Registrations made during the charging period are charged on a pro rata basis. This is a registration charge, not the total cost of UK market entry.
India
Neither CE marking nor FDA clearance automatically permits import or sale in India. The manufacturer and Indian applicant must check the applicable CDSCO route, classification, supporting documents, and licence requirements for the specific device. Overseas regulatory evidence may help support an application, but it does not replace the Indian process.
Which Route Should You Pursue First?
Start with the first shipment your company actually wants to make, then work backwards:
- Name the destination. The EU, US, Great Britain, Northern Ireland, and India need separate market checks.
- Fix the intended purpose and claims. These shape the assessment in each market.
- Classify the device for each destination. Do not carry one market’s classification into another.
- Map your existing evidence. Identify useful reports and the gaps each route leaves.
- Budget for the full launch. Include submission or assessment fees, preparation work, and ongoing obligations.
